Short answer: after a Colorado car accident, care may be paid by your own auto policy's medical payments (MedPay) coverage, by the at-fault driver's liability insurance, by your health insurance, or by a combination. We accept health insurance as an out-of-network provider, auto insurance claims, workers comp claims.
Colorado auto policies must include at least $5,000 of medical payments coverage unless the policyholder rejected it in writing (C.R.S. 10-4-635). MedPay generally pays for reasonable and necessary medical care after a crash, regardless of who was at fault, up to your policy limit. Check your declarations page or ask your adjuster how much you have.
Colorado is an at-fault state, so the driver who caused the crash, through their liability insurance, may ultimately be responsible for your medical bills. These claims can take time to resolve, and many people use MedPay or health insurance in the meantime. Questions about fault and settlements belong with your attorney.
